DMCA Policy
Home Theater Acoustic Panels ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to our designated Copyright Agent.
This policy outlines the procedures for copyright owners to notify us of alleged infringement and for users to file counter-notifications if their content has been removed by mistake.
Filing a DMCA Infringement Notice
If you are a copyright owner or an agent authorized to act on behalf of one, and you believe that any content hosted on our site infringes upon your copyrights, you may submit a written notice of infringement to our designated Copyright Agent. Your notice must include substantially the following:
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Home Theater Acoustic Panels to locate the material (e.g., a specific URL).
- Information reasonably sufficient to permit Home Theater Acoustic Panels to contact you, such as your address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Failure to include all of the above information may result in your DMCA notice not being processed.
Filing a DMCA Counter-Notification
If you believe that material you posted on our site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must be in writing and include substantially the following:
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Home Theater Acoustic Panels may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA infringement notice. If the complaining party does not file a court action seeking an order to restrain the subscriber from engaging in infringing activity on our site within 10-14 business days, the removed material may be restored.
